It’s about the balance of power built into the US constitution and American society. (You’ve probably read Tocqueville.) The balance shifts over time. But the change in the balance is usually driven by the domination of some set of vaues over others. Right now, freedom is valued less than order, resulting in particular legislation, enforcement policies and judicial prejudices.
Judith Miller is just one of the victims in the great swing that has taken place in American politics.
