It’s tough for an innocent person to get the resources to obtain and exoneration unless they get the death sentence. This may be because, as Randy Steidl said in testimony before the Colorado legislature last year, “An innocent man … cannot be released from the grave.”
The innocent person should have thought of that BEFORE committing the crime.
John Thompson spent 14 years on death row for a crime he did not commit, because of prosecutor’s misconduct. This case against government wrong doing went to the Supreme Court.

The thing about the death penalty is that you can never be quite sure. There’s almost always circumstantial evidence.

What about killing in personal self-defense? That seems like a basic right to me.
Of course, execution is not self-defense.
Here’s a scenario/question I’ve heard more than once:
"Is it ok to kill an armed intruder in order to save your family from being murdered, but not ok for the justice system to impose the death penalty if he succeeds in murdering your family, because you weren’t there to prevent it?
A) Homeowner kills armed intruder to save family, they survive.
B) Armed intruder succeeds in murdering family, gets to live (in prison) with 3 squares a day, television, books, visitors, etc, possibly even paroled later.
C) Sentenced to death, which is carried out after 20 years of appeals.
Which is preferable?"

i would prefer to disarm the intruder.
if not possible i would try to daze him, use a tranqulizer gun or theese new electic gun or to hurt him at hands arms legs or whatever…

If it’s allowed to kill in self-defense, you have to define what self defense is.
Is it protecting your house from intruders?
Is it protecting you from any damage?
Is it protecting your life?
Anything else?
For me if you say “it’s OK to kill someone in personal self defense” then it’s OK to kill with an intention to kill. I don’t agree with that, even if the intention is defending you or your family.
It’s not the same as killing someone accidentaly while protecting you.
Of course, in a perfect world, someone killing someone else in a “him or me” situation shouldn’t be punished, but there would be an investigation and, as we’re still in a perfect world, investigators would prove that it was either an accident (no intention to kill) or that there was a real threat on someone’s life.
Since there is so much time available in situations like this, my approach would be to hypnotize the assailant. First, to get them into a relaxed state, play 15 or 20 minutes of Sade. Slowly dim the lights in the room or, if it’s daylight, slowly draw the curtains to reduce the light. Then induce the trance with soothing, hypnotic suggestions.
Oh, snap, he killed me 30 minutes ago. Now that I’m dead I’ll try something else.
